All the officers selected in will be allotted in the state and will be taken on deputation to the center on the basis of fixed percentage i.e. the officer working in the state will not be biased in any state or province and will act impartially and accordingly the Service Act has been framed in All India. Internal Rules have been made and accordingly - from 181 to this day it is implemented as per practice and according to these laws and regulations no officer can be placed in the center without the consultation and consent of the concerned state and also the consent of the concerned officer is required. About 50% of the cadre strength of the concerned state can be sent to the Center on deputation. The condition is that the consultation and consent of the concerned state is required.
All India Service Rules of the above provisions - 12 - 3 (1) are as follows. “A cadre officer may, with the concurrence of the State Government Concerned and Central Government may be deputed for service under Central Government or other State Government or under Company, Association or body of individuals whether incorporated or not, which is wholly or Substantially owned or controlled by the Central Government or by another State Government - Provided that in case of any disagreement the matter shall be decided by the Central Government and the State Government or State Government Concerned shall give effect to the Decision of the Central Government. Thus, in view of these provisions, the consultation of the State Government is mandatory, only when there is disagreement between the State and the Center, the decision of the Center is final and the State has to implement accordingly.
W. In the case of Bengal - Chief Secretary - Appal Bandhopadhyay - his retirement age was 31/7/2071, so the Chief Minister of Bengal proposed to extend his services for three months and it was approved by the Central Government, - The late arrival of the Chief Minister of Bengal in their meeting and the submission of an application form and in which Bandhopadhyay also walked out of the meeting with the Chief Minister as the Chief Secretary, all these events are a reflection of the recent elections in Bengal and the results. But all these things are not healthy democracies but the bitterness of the relationship between the center and the state. (In order)
