Responsibility of the corporation / municipality regarding regulation of hawkers in public places

- People oriented guidance: - H.S. Patel IAS (Retd.)

- TP In the scheme - Lands need to be fully allotted for Hawkers Zone

Continued from the past

Contrary to what was observed in the previous article about the pressure of lorries / gallas on public roads / sidewalks, as well as the lack of political / administrative will which was strongly announced to remove lorries / gallas, the waterdown of the rulers in plain language is true and true. The question of obstacles / pressures has remained the same. The previous article has analyzed the legal situation regarding Larry Galla's public road pressures as well as the Supreme Court judgments. An editorial in the leading newspaper of the Times of India on street vending on lorries and ferries on public roads, but in order to remove lorries on public roads as a form of pressure, as well as to provide employment and livelihood permanently organized (organized). There is no solution. Street Vendors Act - 2016 enacted only Populist Popular Matters Contrary to the relevant Municipalities / Municipalities Act as well as the Supreme Court judgment i.e. the Street Vendors Act has been enacted without a consultation process with all stakeholders. Is not implemented. The Act provides for the formation of a Town Planning Committee for the rehabilitation of hawkers which was not constituted by the concerned Municipal Corporation for many years and is not functioning if it has been constituted. The bottom line is that, first of all, who is the definition of a hawker? In a time when people used to sell goods in a moving truck or on a bed, a hawker is a person who sells kharishing or water which includes cobbler-bootpolis and indeed this is a reasonable hawker. But nowadays the hawkers who have lorries / lorries are permanently operating on public roads as lorries / lorries or shops, i.e. the majority of lorries / lorries do not fall under the definition of lorries. Secondly, if a census has been done on a public road before, it has to be decided from which cut off year there is a right to regulate or allocate, as the pressure of lorries / galleys is increasing day by day like cat mushrooms. .

Due to the prevalence of urbanization in our country as well as migration in search of employment, housing and organized employment are the main factors. According to a study by the Habitat Center of India, 15 to 20 percent of the population work in the unorganized sector. According to a report, people / organizations working in this field also contribute to the country's GDP. But the important question is that the issues of employment and livelihood are reflected in the concept of establishing a welfare state after independence, in the guiding principles of the state policy. But that did not happen. Every citizen has the right to engage in business and employment according to the provisions of the Constitution. To Carryout Trade and Business but on a legal basis, not by obstructing public spaces and the rights of the public, otherwise the lorries / lanes on public roads are where there is more movement of people or business district and there is obstruction of public movement. E.g. Ahmedabad-Bhadra Char Darwaza area, Vadodara-Mangal Bazaar, Kadak Bazaar area around Chauta bridge of Surat, Bedi area of Rajkot etc. Pays installments on a regular basis and this involves collecting certain types of mafia installments as well as keeping lorries / gallas standing. In many places the stationary lorries are equipped, but they are not ready to leave the original place and are restored to their original place even if removed.

In view of the aforesaid existing fact, the Hawking and Non Hawking Zones in each of the cities, like the scheme formulated by the retired District Judge in Vadodara Municipal Corporation, should be approved by the Street Vendors Association as a stockholder. Zone is identified and if space is available then Hawkers Zone is created in the designated space. E.g. During our tenure in Vadodara, next to Aradhana Cinema, in front of Lalbagh, in front of Surasagar Lake, in the notch of Music College etc. Foods sold in public are not healthy at the present time. The Food Security Act must be complied with and not a single food truck can be operated in public. From the perspective of Gujarat, under the Town Planning Act, TP Final plots can be reserved under social infrastructure as part of open commercial activity in the area.

Thus, it is necessary to take steps as per the above instructions for the implementation of social / economic issues related to the regulation of the right of movement on the public roads / footpaths of Lari / Galla Feria citizens. It is imperative that local administrations and rulers follow the orders of the Supreme Court in the interest of the citizens without embarrassing anyone in taking legal action. The Supreme Court has also issued instructions to remove pressure on public places / places of worship. If it is implemented in the true sense, faith in the administration will be established.
